ADR special provision 363
Fuel-powered engines and machinery (UN 3528/3529/3530): only these conditions apply; empty units are exempt; labels, placards and documents scale with fuel.
The entry may only be used when its conditions are met, and then no other ADR requirements apply. It covers engines and machinery powered by dangerous-goods fuels through internal combustion or fuel cells, but not UN 3166 vehicle equipment (special provision 666) or equipment that the 1.1.3 exemptions already cover (see the conditions). Units empty of liquid or gaseous fuel and holding no other dangerous goods are exempt. The fuel type decides the UN number, and other dangerous goods needed for operation add no further requirements unless ADR says otherwise, with special rules for lithium and sodium ion batteries. Construction, closure, orientation and securing rules apply, and labelling, placarding, documentation and tunnel marking depend on fuel quantity or tank capacity. Packing instruction P005 must be met.
| Value | Applies when |
|---|---|
| 2 bar | maximum pressure in gaseous fuel tanks to count as empty |
| 60 l | liquid fuel above which labelling/placarding applies (UN 3528, 3530) |
| 450 l | capacity above which labelling applies |
| 3 000 l | capacity above which placarding applies (UN 3528, 3530) |
| 1 000 l | UN 3529 tank water capacity above which placarding applies; also liquid fuel or tank capacity triggering transport document and orange plates |
Conditions
- (a) Scope: engines or machinery running on dangerous-goods fuels via internal combustion or fuel cells (combustion engines, generators, compressors, turbines, heating units and the like), excluding UN 3166 vehicle equipment under special provision 666; the note to (a) also excludes equipment covered by 1.1.3.7, by 1.1.3.3, and by sub-items (a), (d) and (e) of 1.1.3.2.
- (b) Empty of liquid or gaseous fuel and with no other dangerous goods: not subject to ADR. Liquid-fuelled units count as empty when the tank is drained and the unit cannot run for lack of fuel (lines, filters, injectors and the tank need no cleaning or purging); gas-fuelled units when tanks hold no liquid, tank pressure is 2 bar or less and the fuel shut-off valve is closed and secured.
- (c) Class 3 fuels: UN 3528 engine or machinery, internal combustion or fuel cell, flammable liquid powered.
- (d) Class 2 flammable gas fuels: UN 3529 engine or machinery, internal combustion or fuel cell, flammable gas powered; dual gas and liquid fuelled units also take a UN 3529 entry.
- (e) Liquid fuels that are only environmentally hazardous (2.2.9.1.10): UN 3530 engine or machinery, internal combustion.
- (f) Other dangerous goods needed for operation or safety (batteries, extinguishers, gas accumulators, safety devices) add no requirements unless ADR says so; lithium batteries must meet 2.2.9.1.7.1 and sodium ion batteries 2.2.9.1.7.2, with the listed sub-items waived for production runs of up to 100 or pre-production prototypes carried for testing.
- (g) Built to the construction requirements of the competent authority of the country of manufacture.
- (h) Valves and openings, including vents, closed in carriage.
- (i) Oriented to avoid leakage and secured against movement that would change orientation or cause damage.
- (j) UN 3528 and 3530: with more than 60 l of liquid fuel, labels on two opposite sides (5.2.2) for capacity over 450 l up to 3 000 l, and placards on two opposite sides for capacity over 3 000 l, matching column (5) labels, to 5.3.1.7, on a contrasting background or with a dotted or solid outer border; labelling or placarding is optional above 450 l capacity with 60 l of fuel or less.
- (k) UN 3529: fuel tank water capacity over 450 l up to 1 000 l, labels on two opposite sides; over 1 000 l, placards on two opposite sides as in (j).
- (l) Over 1 000 l liquid fuel (UN 3528, 3530) or tank water capacity over 1 000 l (UN 3529): a 5.4.1 transport document with the special provision 363 statement, and for journeys through restricted tunnels orange-coloured plates (5.3.2) with the 8.6.4 tunnel restrictions applying.
- (m) Packing instruction P005 of 4.1.4.1 must be met.

Note. The provision runs from page 627 to page 629. A footnote to (g) names EU machinery Directive 2006/42/EC as an example of compliance. Condition (c) prints the first entry as UN 3528 and the rest as UN No. 3528; they are the same number.
